Prize, participation period and date of the draw

The respective prize will be described in detail in the announcement post. The deadline for participation in the respective competition will be announced in the announcement on the respective channel of studierendenWERK BERLIN. The date of the prize draw is also included in the respective post and is binding.

Circle of eligible participants

Eligible participants are students with a valid enrollment at one of the cooperating universities of studierendenWERK BERLIN. The possible use of the services of studierendenWERK by competition participants has no effect on the outcome of the competition. Participation in the competition requires a place of residence in Germany. 

Determination of the winners

The winners will be drawn at random. Participants will be assigned numbers depending on the number of entries received. The winning numbers will be drawn from the total number of participants using an online random number generator.

Legal recourse

Legal recourse is excluded with regard to the drawing of the winners and the possible evaluation of the submitted competition entries.

Notification of winners and entitlement to prizes

The winners will be notified promptly after the draw via social media chat or email. They must respond within two weeks, otherwise the prize will be forfeited. They can either collect their prize at the InfoPoint of the studierendenWERK BERLIN at Hardenbergstraße 34 10623. If they do not do so within two weeks, the prize will be forfeited. If the winners provide their postal address, they will receive the prize by post.

Participants are responsible for the accuracy of the contact details provided. If the prize cannot be delivered to them due to incomplete or incorrect contact details, the claim to the prize will be forfeited. Winnings may not be paid out in cash or in kind, exchanged or transferred to other persons


Responsibility of the participants

The studierendenWERK BERLIN is not responsible for the behavior and content published by the participants in the context of the competition and does not adopt it as its own. Furthermore, it is not obliged to review such content, but reserves the right to withdraw its publication if there are concrete indications that the content violates legal requirements, official prohibitions, the rights of third parties or morality.

Exclusion in the event of misuse

studierendenWERK BERLIN reserves the right to exclude participants who, without this being expressly permitted, use multiple email addresses, social media accounts or the like to increase their chances of winning, technically manipulate the competition or the course of the game or otherwise violate these conditions of participation or the law, at any time and without prior notice from participation in the competition, taking into account the reasonableness criteria.

Responsibility for content

Participants must ensure that they have the necessary rights of use to the content for participation in this competition and that its use within the scope of these conditions of participation does not violate legal regulations, common decency and/or the rights of third parties. In particular, if other persons besides the participants can be recognized in photos or videos, their submission is only permitted if the consent of the third party or parties has been obtained and the personal and data protection rights of third parties are not violated.

Naming the winners
studierendenWERK BERLIN will not publicly disclose the names of the winners without the explicit consent of those concerned.

Competitions within online platforms

If the competition takes place within an online platform, a digital application or a social network (e.g. Facebook or Instagram, the mailing program Cleverreach or the homepage CMS MODX, hereinafter referred to as “online platform”), the following provisions also apply.

Notes on warranty and liability

We would like to point out that the competition and the prizes are voluntary services on our part, for which the same scope of warranty and liability does not apply as, for example, in the case of a purchase of the prizes independent of the competition.

Limitations of the warranty for prizes

Subject to our own fault in accordance with the provisions in the liability information in these conditions of participation, we are not liable for items and services won that are not offered by us. In all other respects, the warranty and guarantee conditions of the respective providers of the items and services apply, provided that these do not restrict the participants and cannot be transferred by us to the participants.

Suspension or restriction of the competition

We would like to point out that the availability and function of the competition can only be guaranteed to a reasonable extent for us and the participants. We may terminate the competition at any time, in particular due to external circumstances and constraints. External circumstances and constraints include, in particular, technical problems, legal changes or mandatory measures by third parties that are beyond our control.

Participants may not assert any claims against the online platform that arise in connection with participation in the competition or its use. Participants acknowledge that the competition is in no way sponsored, supported or organized by the online platform or has no connection with the online platform.All information and data provided by or collected from participants as part of the competition will be provided only to us and not to the online platform. We ask that all inquiries and information regarding the competition be directed to us and not to the online platform.
If we receive participants' data from the online platform on the basis of their permission or other legal authorization, this data will only be used, stored and otherwise processed for the purposes stated in the competition (e.g. if we can pre-enter the user's email address in a competition form).
If participants are asked to enter access data, this data will be processed by the provider of the online platform. In particular, we do not receive access to the participants' passwords.

 

Notes on liability

The following exclusions and limitations of liability apply to our liability for damages, notwithstanding the other statutory requirements for claims. Insofar as liability on our part is excluded or limited, this shall also apply to the personal liability of our employees, representatives and vicarious agents. We are liable for the slightly negligent breach of essential obligations, the breach of which jeopardizes the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which is essential for the proper execution of the competition and on the observance of which the contractual partners regularly rely (so-called cardinal obligations).In this case, however, we shall only be liable for the foreseeable damage typical for the contract. We are not liable for the slightly negligent breach of the obligations mentioned in the above sentences by others. We shall be liable without limitation insofar as the cause of the damage is based on intent or gross negligence.In the event of a grossly negligent breach of duty by our vicarious agents, the aforementioned limitations shall apply to the slightly negligent breach of material duties.

The above limitations of liability shall not apply in the event of injury to life, limb or health, for a defect following the assumption of quality guarantees for the quality of a product and in the event of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.

As data subjects, participants are entitled to various rights under the GDPR, which arise in particular from Art. 15 to 18 and 21 GDPR:
- Right to object: You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on point (e) or (f) of Article 6(1) GDPR, including profiling based on those provisions. If the personal data concerning you are processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing.
- Right to withdraw consent: You have the right to withdraw any consent you have given at any time.

- Right of access: You have the right to obtain confirmation as to whether or not personal data concerning you is being processed and access to this data as well as further information and a copy of the data in accordance with the legal requirements.
- Right to rectification: You have the right to request the completion of data concerning you or the rectification of inaccurate data concerning you in accordance with the legal requirements.
- Right to erasure and restriction of processing: In accordance with the legal requirements, you have the right to demand that data concerning you be erased immediately or, alternatively, to demand that the processing of the data be restricted in accordance with the legal requirements.
- Right to data portability: You have the right to receive the data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format in accordance with the legal requirements or to request its transmission to another controller.
- Complaint to the supervisory authority: You also have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes the GDPR.
